TERMS AND CONDITIONS OF THE RAFFLE 1. INTRODUCTION 1.1 The present clauses regulate the terms and conditions (hereinafter ‘Legal Bases’) of the B&me Rewards July 2024 prize draw (hereinafter the ‘Prize Draw’) which consists of a prize draw organised by B&B HOSPITALITY ESPAÑA, S.L., (hereinafter ‘B&B HOTELS’). 1.2 B&B HOTELS informs you that your membership in B&me allows you to participate in this draw without the need to perform any specific action, these being the Legal Bases governing the Sweepstakes described. 1.3 As a B&me member and participant, you declare that you are aware of all the contents of this document, which has been made available to you on the hotelbb.com website, and you undertake to comply with the provisions described herein, adhering fully and unreservedly to the conditions described. 2. PURPOSE OF THE DRAW The purpose of the prize draw is to encourage and promote registration in the B&me loyalty programme, as well as to reward the loyalty of members already registered, to promote its brand and hotels respectively, as well as to increase its digital community. For more information: bbhotels.com , @bbhotelsspain. 4. TERRITORIAL SCOPE This Sweepstakes will be valid only in Spain and Portugal. 5. DURATION 5.1 This prize draw will run from 23/07/2024 until 04/08/2024 at 23:59. The winner will be announced by email on Monday 5/08/2024. The participants of the Sweepstakes will be all active B&me members during the above mentioned dates. The member will not be required to register or make any additional entries to participate in the Sweepstakes. B&B HOTELS reserves the right to advance or postpone the duration of the Sweepstakes, as well as to modify this Sweepstakes, extend and even cancel it if it deems appropriate or for reasons that prevent the celebration of the same. 6. TO WHOM THE PRIZE DRAW IS ADDRESSED AND EXCLUSIONS 6.1 This prize draw is aimed at all natural persons of legal age (hereinafter ‘Participant’ or ‘Participants’), who are B&me members during the aforementioned period of validity. 6.2 The following are excluded from this Sweepstakes: (i) persons who do not comply with the provisions of the previous paragraph (6.1); (ii) employees of B&B HOSPITALITY ESPAÑA, S.L. as well as distributors, external collaborators, advertising agencies, promotion agencies, any person who has participated or has been involved in the preparation of this promotion, directly or indirectly, in the organization, development, etc., and their families. 7. PARTICIPATION REQUIREMENTS 7.1 In order to participate in this prize draw, it is essential that you meet the following requirements: - Comply with the provisions of Section 6. - Be of legal age - You must be an active B&me member at the time of the Sweepstakes. 8. PRIZE OF THE PRIZE DRAW 8.1 The prize is: - A 1-night stay for 2 people in any B&B HOTELS in Spain or Portugal for stays within the dates of the festival as well as two tickets for one of the festivals present in the B&me festival line-up. B&B HOTELS reserves the right to purchase the festival tickets on the festival line-up subject to availability. The prize will be sent to the winner, after being located, to the shipping address provided to B&B HOTELS through a courier company. Also the enjoyment of the stay will be subject to the specific availability of each hotel on the date of enjoyment chosen by the winner within the period of validity of this Sweepstakes. 8.2 In all cases, the prize is strictly subject to the following conditions. 9. SELECTION OF THE FINAL WINNERS AND COMMUNICATION OF THE PRIZE 9.1 This prize draw will run from 23/07/2024 until 04/08/2024 at 23:59. The winner will be announced by email on Monday 5/08/2024. 9.2 The winner will be chosen randomly through https://app-sorteos.com/es, ensuring full transparency and randomness of the result which will be unalterable by B&B HOTELS as organizer. The system will choose 1 winner and 2 alternates in the event that the winner does not meet the requirements to win the prize set out in paragraph 7, or can not be contacted within the deadline. 9.3 B&B HOTELS will carry out the necessary checks in order to ensure that the winner of the Draw meets the aforementioned requirements to participate. 9.4 It will be notified on 07/06/2024 through the email address used by the member in his registration at B&me. 9.5 If within two (2) calendar days of the Sweepstakes being held, B&B HOTELS has not been able to contact the winner or is unable to contact the winner, B&B HOTELS will be notified by e-mail on 07/06/2024.  9.5 If within two (2) calendar days of the Sweepstakes, B&B HOTELS has not managed to contact the winner or it has been found that the data provided is incomplete or false, the winner will lose the prize and B&B HOTELS will proceed to contact the first alternate on the list. The same will occur if the first alternate does not respond, the data provided is incomplete or false. In the event that the second alternate does not respond, B&B HOTELS will repeat the draw among the remaining participants. This procedure will be repeated until B&B HOTELS can contact the winner, who will be identified as the ‘Final Winner’. 9.6 The Prize Draw will have a Final Winner, except in the unlikely event that by the dates of the 2024 Festival, the maximum date set for enjoying the prize, it has not been possible to contact any winner who meets the requirements of paragraph 7. 10. ADDITIONAL CONDITIONS 10.1 In order that the final winner can obtain and collect the prize object of this draw, must be identified through the National Identity Card of Spain or passport number, as appropriate. 10.2 B&B HOTELS will communicate to the winner the necessary details to enjoy the prize. 10.3 Under no circumstances may the prize be replaced by financial compensation. 11. DISQUALIFICATION OF A PARTICIPANT This Sweepstakes is intended to encourage participation on equal terms and with respect to the general principle of good faith of all Participants. B&B HOTELS reserves the right to disqualify a Participant, making void their participation, when it breaches any clause of these Terms and Conditions, or their data provided were not truthful. Also, when your participation involves manipulation, fraud or conduct in bad faith, B&B HOTELS will not deliver the prize to the winner, being automatically excluded from participation, reserving the right to take legal action as appropriate. 12. B&B HOTELS LIABILITY 12.1 In the event that you are unable to participate or receive related communications, for reasons beyond the control of B&B HOTELS, such as, for example, internet connection problems or force majeure, B&B HOTELS shall not be liable. 12.2 The Final Winners will be solely responsible for the use they make in relation to the prize they obtain, in case of fraudulent or reckless acts on their part. 12.3 B&B HOTELS shall not be liable for any manipulation, fraud or conduct in bad faith by a participant. 13. TAX OBLIGATIONS OF THE WINNERS The final winner will be individually responsible for the payment of the tourist tax of the destination chosen to redeem their prize. 14. The treatment is legitimized on the basis of the express consent that is requested during the registration process as a member B & me and you give freely, since membership in the loyalty program B & me is voluntary. Your data will be kept for the duration of the celebration and management of the draw, including the communication and management of the prize, as well as the time necessary to comply with the legal obligations arising, after which they will be destroyed. The transfer of data is not foreseen, unless legally required, as it is essential for the management and development of the present processing of personal data, nor are international transfers of data foreseen. INTELLECTUAL AND INDUSTRIAL PROPERTY B&B HOTELS reserves all Intellectual and Industrial Property rights that form part of this Sweepstakes. Participants undertake not to infringe the aforementioned rights or other rights recognized to B&B HOTELS or third parties. In any case, the Participant will be responsible for the aforementioned infringements that may cause B&B HOTELS or third parties. 16. APPLICABLE LAW: For all matters not specified in these Legal Bases, this Sweepstakes shall be subject to the Spanish regulations in force at the time of the celebration of this Sweepstakes. The Courts and Tribunals of the city of Madrid will be competent to resolve any controversy or claim that may arise in relation to the validity, interpretation or fulfilment of these Legal Bases. 17.
